1. AGREEMENT
These Terms of Use (“Terms”) govern access to and use of the My Sask Senior Living LTD. platform, website, directory, forms, communications, content, and related services (collectively, the “Platform”) by individuals seeking information, navigation, guidance, or referrals, including clients, family members, caregivers, and general website users (collectively, “Users”). By accessing or using the Platform, submitting information, or requesting services, the User agrees to be bound by these Terms. These Terms form a binding agreement between the User and My Sask Senior Living LTD. (“MSSL”).
If a User does not agree to these Terms, the User must not access or use the Platform. MSSL may update these Terms from time to time by posting a revised version on the Platform, and continued use after any update constitutes acceptance of the revised Terms to the extent permitted by law.
2. PLATFORM SERVICES
MSSL operates a Saskatchewan-based platform intended to help individuals, families, and caregivers locate, review, and connect with senior housing, care, and related service providers. The Platform may provide directory listings, educational content, navigation support, referral coordination, intake support, provider information, and related tools or communications.
The Platform does not operate housing, care homes, home care services, medical services, or other third-party services listed on the Platform. MSSL does not make placement decisions, does not admit or accept individuals into any residence or service, and does not provide medical, legal, financial, or other regulated professional advice. Any information made available through the Platform is provided for general informational and navigation purposes only.
3. NAVIGATION PATHWAYS
Users may access or use the Platform through one or more of the following navigation pathways:
3.1 Self-Serve Use (Independent Navigation)
Users may independently browse provider listings, educational content, categories, and other publicly available information on the Platform. Self-serve use is offered for general informational purposes only and does not include personalized recommendations, suitability assessments, placement services, or professional advice.
Users are solely responsible for evaluating the completeness, relevance, and suitability of any provider, service, residence, or information accessed through self-serve use. MSSL does not guarantee that self-serve results are complete, current, suitable, or tailored to any User’s needs.
3.2 Navigation Services (Paid Services)
MSSL may offer one or more fee-based navigation service options designed to assist Users in exploring senior housing, care, and related support services. Depending on the navigation service selected, services may include consultation, discussion of housing and service options, educational guidance, navigation support, referral introductions, tour coordination, follow-up communications, and other navigation assistance based on the information provided by the User and the information reasonably available to MSSL at the time.
Navigation services may focus exclusively on providers participating in MSSL's Connected Community network or may include both Connected Community and non-Connected Community providers, depending on the navigation service selected by the User. Where navigation is limited to Connected Community providers, Users acknowledge that recommendations may not represent the entire marketplace.
Navigation services are informational and supportive in nature only. MSSL does not provide case management, care management, admissions services, advocacy services, decision-making services, or regulated professional advice. MSSL does not guarantee placement, acceptance, provider availability, pricing, waitlist movement, service quality, funding eligibility, response times, or any particular outcome. Users remain solely responsible for evaluating available options and making their own decisions regarding housing, care, and service providers.
Navigation services are provided on a fee-for-service basis. Where a User subsequently selects a participating Connected Community provider and a successful move-in or commencement of services occurs, the navigation fee paid for that engagement may be reimbursed in accordance with the reimbursement terms set out in the applicable Client Agreement.
4. THIRD-PARTY PROVIDERS
All providers, residences, businesses, and service organizations listed on or referred through the Platform are independent third parties and are not owned, controlled, operated, or supervised by MSSL. Any relationship formed between a User and a provider is solely between those parties unless expressly stated otherwise in writing.
MSSL may review, moderate, organize, or publish provider-submitted information, but MSSL does not guarantee that all provider information is complete, accurate, current, lawful, available, or suitable for a particular User. Users are responsible for conducting their own due diligence, asking questions, reviewing contracts, confirming credentials, visiting locations, and obtaining independent medical, legal, financial, or other professional advice where appropriate.
5. NO GUARANTEES OR PROFESSIONAL ADVICE
The Platform and its services are intended to assist Users with information, navigation, and introductions only. MSSL does not guarantee placement, provider acceptance, eligibility, service availability, quality of care, waitlist timing, pricing accuracy, licensing status, outcome, or suitability.
No content, communication, recommendation, listing, referral, intake discussion, or navigation support provided by MSSL constitutes medical advice, legal advice, financial advice, case management, or a professional opinion. Users must rely on their own judgment and, where appropriate, the advice of qualified professionals before making decisions affecting housing, care, health, finances, or legal rights.
6. USER RESPONSIBILITIES
Users agree to provide information that is accurate, current, and not misleading to the best of their knowledge. Users are responsible for ensuring that they have the authority to provide information on behalf of another person, including a senior, family member, or dependent, where applicable.
Users must use the Platform lawfully and respectfully. Users must not misuse forms, submit false inquiries, interfere with the operation or security of the Platform, attempt unauthorized access, copy or scrape Platform content for commercial use without permission, or use the Platform in a way that is fraudulent, abusive, defamatory, or unlawful.
7. FEES, PAYMENTS, AND REFUNDS
Fees for paid navigation or other paid services, where applicable, will be disclosed before purchase or engagement. By purchasing a paid service, the User agrees to pay the disclosed fees and any applicable taxes.
Unless otherwise stated in a separate written policy or service agreement, fees paid for services already performed, consultations already provided, or work already commenced are non-refundable. MSSL may, in its discretion, consider refunds, credits, or rescheduling in exceptional circumstances, but is not required to do so unless required by law. Nothing in these Terms limits any non-waivable consumer rights that may apply under Saskatchewan or Canadian law.
8. PRIVACY AND CONSENT
Use of the Platform is subject to MSSL’s Privacy Policy, which forms part of these Terms by reference. By submitting personal information through the Platform, the User agrees that MSSL may collect, use, and disclose that information in accordance with the Privacy Policy and for the purposes of operating the Platform, communicating with the User, and facilitating navigation or referrals where requested.
Where a User requests that MSSL connect them with a provider or assist with a referral, the User authorizes MSSL to share relevant information reasonably necessary to facilitate that request, subject to applicable law and MSSL’s Privacy Policy.
9. INTELLECTUAL PROPERTYAll content on the Platform, including text, branding, logos, design elements, layout, graphics, compilations, and original material created by or for MSSL, is owned by MSSL or its licensors and is protected by applicable intellectual property laws. Users may access and use Platform content only for personal, non-commercial, lawful use related to the Platform’s intended purpose.
Users may not copy, reproduce, distribute, republish, sell, modify, create derivative works from, or exploit Platform content without prior written permission from MSSL, except as permitted by law. Provider-submitted content may remain subject to the rights of the submitting provider, but by submitting content to MSSL, the provider grants MSSL the rights reasonably necessary to review, display, format, publish, and use that content for Platform operations, subject to any separate provider agreement.
10. AVAILABILITY AND CHANGESMSSL may modify, suspend, restrict, or discontinue any part of the Platform or its services at any time, with or without notice, including listings, pathways, features, pricing, referral structures, or content. MSSL is not liable for any loss arising from service interruptions, technical issues, content changes, or removal of features, except as required by law.
11. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, the Platform and all services, content, listings, and communications are provided on an “as is” and “as available” basis without warranties, representations, or conditions of any kind, whether express, implied, or statutory. MSSL disclaims, to the fullest extent permitted by law, all implied warranties or conditions of accuracy, completeness, fitness for a particular purpose, merchantability, non-infringement, uninterrupted access, and error-free operation.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law, MSSL and its owners, officers, directors, employees, contractors, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive loss, damage, cost, or expense arising from or related to the use of, or inability to use, the Platform or any provider, listing, referral, communication, or service accessed through the Platform. This includes, without limitation, decisions made by Users, acts or omissions of third-party providers, missed opportunities, incorrect or incomplete information, delays, service interruptions, loss of data, emotional distress, relocation outcomes, or dissatisfaction with a provider or service.
Where any liability cannot be excluded by law, MSSL’s total aggregate liability shall be limited to the amount, if any, paid by the User directly to MSSL for the specific paid service giving rise to the claim in the twelve (12) months preceding the event giving rise to the claim. This limitation applies only to the extent permitted by law.
13. INDEMNITY
The User agrees to indemnify and hold harmless MSSL and its owners, officers, directors, employees, contractors, agents, and affiliates from and against any claims, demands, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to the User’s misuse of the Platform, breach of these Terms, violation of applicable law, infringement of rights, or submission of false, misleading, unauthorized, or unlawful information.
14. TERMINATION OR RESTRICTION OF ACCESSMSSL may suspend, restrict, or terminate a User’s access to the Platform or any related service at any time, without notice, where MSSL reasonably believes the User has violated these Terms, misused the Platform, created risk for MSSL or others, or acted unlawfully or abusively. Termination or suspension does not affect any accrued rights, obligations, disclaimers, or limitations that by their nature should survive termination.
15. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the Province of Saskatchewan and the applicable federal laws of Canada. Any dispute arising out of or relating to these Terms, the Platform, or its services shall be subject to the exclusive jurisdiction of the courts of Saskatchewan, unless otherwise required by applicable law.
16. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
17. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and any additional written service terms, disclosures, or policies expressly incorporated by reference, constitute the entire agreement between the User and MSSL regarding use of the Platform and supersede prior discussions or understandings relating to that subject matter.
